1. Agreement to Terms

By accessing or using EvokeWrite ("Service") provided by Evoke AI s.r.o., you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

EvokeWrite is a software-as-a-service (SaaS) platform accessible at https://evokewrite.com. The Service provides AI-powered inspection reporting and document generation tools.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information and promptly update any changes.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) violate any applicable laws or regulations; (c) infringe upon intellectual property rights of others; (d) transmit malicious code or interfere with the Service; (e) attempt to gain unauthorized access to the Service or related systems; (f) use the Service to generate harmful, misleading, or illegal content.

5. Intellectual Property

All rights, title, and interest in the Service, including software, designs, and trademarks, are owned by Evoke AI s.r.o. You retain ownership of content you create using the Service, subject to any applicable third-party terms.

6. Payment and Billing

Paid features are billed in advance on a subscription basis. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

7. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED CONTENT MAY CONTAIN ERRORS AND SHOULD BE REVIEWED BEFORE USE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVOKE AI S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Evoke AI s.r.o. and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of Prague, Czech Republic.
